1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and BIVIO GAME LTD ("we," "us," or "our"). For full company details, see the Contact Us section below.

By downloading, installing, accessing, or using the Big Homescreen application (the "App"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

You represent that you are at least 18 years of age, or the age of majority in your jurisdiction, whichever is greater. If you are under the required age, you may not use the App.

2. The Service

Big Homescreen is a free Android home screen launcher designed for ease of use, featuring large text, simplified navigation, and essential tools for everyday use. The App includes the following features:

• Home Screen Launcher: A simplified home screen with large icons and text for easy navigation.
• Weather: Local weather information based on your approximate location.
• News: Aggregated news from multiple public RSS sources.
• Tools: Magnifier (camera-based), QR code scanner, flashlight, and quick access to device settings.
• SOS Emergency Button: Quick access to emergency calling features.
• App Drawer: An organized view of all installed applications with search and sorting.

The App is provided free of charge and is supported by advertisements. We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice.

3. Launcher and Uninstallation

What is a Launcher?

A "launcher" is an Android application that serves as your device's home screen. When you set Big Homescreen as your default launcher, it replaces your device's default home screen experience.

Changing Your Default Launcher

You can change your default launcher at any time:

1. Open your device's Settings app.
2. Navigate to Apps (or Apps & notifications).
3. Tap Default apps (or Choose default apps).
4. Tap Home app (or Launcher).
5. Select a different launcher from the list.

The exact steps may vary depending on your device manufacturer and Android version.

Uninstalling Big Homescreen

To uninstall Big Homescreen:

1. First, switch to a different launcher using the steps above.
2. Go to Settings > Apps > Big Homescreen.
3. Tap Uninstall.

Alternatively, you can find Big Homescreen in the Google Play Store and tap Uninstall.

Uninstalling the App will remove all locally stored data, including your preferences and settings.

4. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a compatible Android device that you own or control, solely for your personal, non-commercial purposes.

You may not:

• Copy, modify, adapt, translate, or create derivative works of the App or any part thereof.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent expressly permitted by applicable law.
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the App.
• Distribute, sublicense, lease, rent, loan, or otherwise transfer the App to any third party.
• Use the App for any commercial purpose without our prior written consent.
• Use automated systems, bots, or scripts to interact with the App.

5. Intellectual Property

The App, including all content, features, functionality, design, graphics, trademarks, and logos, is owned by BIVIO GAME LTD and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

"Big Homescreen," "Big Easy App," and associated logos are trademarks of BIVIO GAME LTD. You may not use our trademarks without our prior written permission.

All rights not expressly granted in these Terms are reserved.

6. Prohibited Conduct

You agree not to:

• Use the App in any manner that violates any applicable law or regulation.
• Use the App to transmit any malware, viruses, or other harmful code.
• Attempt to gain unauthorized access to the App, its servers, or any related systems or networks.
• Interfere with or disrupt the integrity or performance of the App.
• Use the App to infringe upon the rights of any third party.
• Use the App in any way that could damage, disable, overburden, or impair our services.
• Circumvent, disable, or otherwise interfere with any security or access control features of the App.
• Use the App to collect or harvest any information from other users without their consent.
• Manipulate or interfere with the advertising systems within the App, including but not limited to artificially generating ad impressions or clicks.

7. Third-Party Content

The App may display content from third-party sources, including but not limited to:

• News Articles: The App aggregates news from third-party RSS feeds (such as news organizations). We do not author, edit, or endorse any third-party news content. News articles are the sole responsibility of their respective publishers.
• Weather Data: Weather information is provided by third-party weather services and may not always be accurate or up to date.
• Advertisements: The App displays advertisements provided by third-party advertising networks. We are not responsible for the content, accuracy, or availability of any advertisements or the products/services they promote.
• External Links: The App may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party websites or services.

Your interactions with third-party content and services are governed by the terms and privacy policies of those third parties. We encourage you to review the applicable terms and policies before engaging with third-party content.

8. Emergency Feature Disclaimer

The App includes an SOS emergency button feature designed to provide quick access to emergency calling capabilities on your device. Please read this section carefully.

• The SOS feature is a convenience tool that attempts to initiate an emergency call through your device's existing phone capabilities. It is not a dedicated emergency communication service.
• We do not guarantee that the SOS feature will successfully connect you to emergency services. The feature's ability to function depends on your device's hardware, software, cellular network connectivity, and your location.
• The SOS feature is not a substitute for dedicated emergency communication devices, medical alert systems, or professional emergency services.
• We are not responsible for any failure of the SOS feature to connect to emergency services, any delays in emergency response, or any consequences arising from reliance on the SOS feature.
• In a life-threatening emergency, you should always attempt to contact emergency services directly by dialing the appropriate emergency number for your location (e.g., 911 in the United States, 112 in the European Union, 999 in the United Kingdom).

9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

• THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
• THE RESULTS OBTAINED FROM THE USE OF THE APP WILL BE ACCURATE OR RELIABLE.
• ANY DEFECTS IN THE APP WILL BE CORRECTED.
• THE APP WILL BE COMPATIBLE WITH ALL DEVICES OR OPERATING SYSTEM VERSIONS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. IN SUCH JURISDICTIONS, THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BIVIO GAME LTD, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
• LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
• DAMAGES RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; (C) ANY THIRD-PARTY CONTENT OR CONDUCT; (D) ANY FAILURE OF THE SOS EMERGENCY FEATURE; OR (E) ANY OTHER MATTER RELATING TO THE APP.

THE APP IS PROVIDED FREE OF CHARGE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP SHALL NOT EXCEED ZERO US DOLLARS ($0.00 USD).

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to indemnify, defend, and hold harmless BIVIO GAME LTD, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

• Your use of the App.
• Your violation of these Terms.
• Your violation of any applicable law or regulation.
• Your violation of any rights of a third party.

12. Google Play Terms

The App is made available through the Google Play Store. The following additional terms apply:

• Maintenance and Support: BIVIO GAME LTD, not Google, is solely responsible for providing maintenance and support for the App. Google has no obligation to provide any maintenance or support services with respect to the App.
• Warranty: BIVIO GAME LTD, not Google, is responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Google, and Google may refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Google will have no other warranty obligation with respect to the App.
• Product Claims: BIVIO GAME LTD, not Google, is responsible for addressing any claims relating to the App or your possession and use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.
• Intellectual Property: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, BIVIO GAME LTD, not Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Sanctions Compliance: You represent and warrant that: (a) you are not located in a country that is subject to a US Government embargo or that has been designated by the US Government as a "terrorist supporting" country; and (b) you are not listed on any US Government list of prohibited or restricted parties.
• Third-Party Beneficiary: You acknowledge and agree that Google and its subsidiaries are third-party beneficiaries of these Terms, and that Google will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

13. Open-Source Software

The App uses the following open-source libraries, each subject to its own license terms:

Nothing in these Terms limits your rights under, or grants you rights that supersede, the terms of any applicable open-source license.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

For EU and UK consumers: Nothing in these Terms shall affect your rights under mandatory consumer protection laws of your country of residence. If you are a consumer in the EU, you may also bring proceedings in the courts of the EU member state in which you are domiciled. EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BIVIO GAME LTD with respect to the App and supersede all prior or contemporaneous communications, agreements, and understandings, whether oral or written.
